My husband and I have recently seperated and we have 3 children. He was recently injured and is receiving workman's compensation and is expecting a large settlement, because he was injured and recovered and lawsuit was established during our marriage and before he left am I entitled to half of the settlement? what can I do to ensure I get my share? He has given me a verbal agreement to half but that is not valid in court is it?

My response:

Certain forms of monies are not marital property. Money received for a personal injury, or money that has been inherited, or gifts, are not considered marital property - - they are always considered, under the law, to be separate property, unless there is some form of written agreement to the contrary.

Your verbal agreement isn't worth the paper it's written on.

Besides, HE was the one injured; not you. Why would you expect to benefit from HIS loss when you are not even together any longer?

HE is the one that will suffer/live with the accident, not you. Therefore, HE is entitled to the money he receives.
