Am I falsely charged?

What is the name of your state? Texas

Here is the scenario:

I was sitting in the back seat of the car. The driver gets pulled over for "failing to dim headlights". The officer finds a partially empty bottle of beer in the cooler in the back seat. Me and the passenger get a ticket for "CONSUMING ALCOHOL WHILE DRIVING".

If I pay the ticket, I am worried about how that will look...

...on my motor vehicle report
...to my insurance co.
...to officers who pull me over in the future
...to a judge (god forbid) that looks at my prior record

Any advice? Do I need a traffic attorney? Am I being charged with a "moving" violation? Should this get thrown out?
