My daughter (age 16) went to court after being in jail for 15 days for possession of marijuana and assault (to me) the other day and the judge said he would let her out if I would take a drug test. My ex wife told her PO that I smoked marijuana. I tested positive for marijuana.

I had a prescription for medical marijuana from another state when I lived there but in my state (the one I live now) it is illegal. I am on pain medication now and I explained this to the judge. The judge is setting me up with a councilor and allowed my daughter to go home after saying he would not if I tested positive.

I am trying to change my daughter probation officer for many reasons and when I spoke to her supervisor today he keeps throwing over my head "you tested positive for marijuana and you may not be a good parent for her" and I should leave well enough alone. He is being very difficult.

I am waiting for a PO to call me to discuss what counciling I need.

My questions are:

Can they press charges against me? Can they do anything to me? Do I have anything to worry about? Can they take my daughter away from me?

The judge put her on 30 days house arrest and probation and we go to a A&D hearing in two weeks to meet with the judge again. What is an A&D hearing?
