Am I legally Married???

What is the name of your state? Maryland

I need help I am a recent retire Marine and now divorcing my current alien wife and do not know what to do or if I was leagally married to her. We married in November 1996 under her work visa in Noth Carolina. He work visa expired six months after being married. Left North Carolina within that time period to my other duty station in California and then to Maryland within 7 years. She did not apply for a new work visa or any INS paperwork in either state. She received a Michagin Social Security Card with her work visa and has been undected by any government agency.

My question is was I leaglly married to her and what do I do now? I do not want to reuin my current government job because of my soon to be ex wife's mistake.

How does her not applying for a new visa affect whether or not you were legally married? Her immigration status has absolutely nothing to do with the legality of your marriage. If you were legally married in your state, then you are legally married. Just because she may have become an out of status foreign national for failure to renew her visa or to file for permanent residence on the basis of her marriage to you does not invalidate an otherwise legitimate marriage.
