I live in Washington state.

On 4/16/09, I was having an instant-messaging conversation with my web host. He was consulting me/thinking aloud when he listed one of his services as remote backup. He said it was $5/mo for weekly backups.


I quote precisely from my chat log:

Webhost: Would you pay $5 a month for weekly backups?
Me: Yeah
Me: I think I might get that
Me: xD
Webhost: So you want remote backup services?
Me: That's what she said
Webhost: open up your piggy bank ;)

......(few minutes later).....
Webhost: You've got mail, btw ;)
Me: again?
Webhost: Yes...you request a service and I magically give it
Me: i'll pay soon :) is that monthly or weekly? don't do it until I pay
Webhost: monthly
Me: kk
Webhost: five days is what it will give you before it suspends, lol...you should be getting an "overdue invoice" email at some point this week :p

Anyways, he suspended my account today. I'm not effing obligated to pay, am I? I explicitly said don't do it until I pay.

Based on your post, you are obligated to pay.

Reason:
You said, "i'll pay soon is that monthly or weekly? don't do it until I pay
Webhost: monthly

Presumably, you then USED their service when it was available. Your USE is acceptance of the terms.
