In July 1997 my daughter fell and broke her collar bone while we were camping. The emergency physician failed to submit the claim with my insurance company. They also waited 25 months to contact me. At that time, I contacted the insurance and was informed that the 24 month time frame to file had lapsed. I passed this information along. So they did file the claim but changed the date from July 1997 to July 1999. It was denied because I no longer had coverage as of June 1999. The collection agency is now saying that the remainder of this debt is my responsibility. Is this the case?

My response:

While some hospitals and doctors do, in fact, bill insurance directly on behalf of a patient, this is done as a "courtesy" and is not required. The ultimate responsibility for "following up" and to make sure that your insurance was notified in a timely fashion of the claim, rests on your shoulders.

The billing now belongs to you to pay.
