I just bought a phone online from the Amazon marketplace. It was clearly advertised as "unbranded and unlocked" (not tied to any cell phone service). This is essential for the manner in which I want to use the phone. I have the receipt for purchase that says the same.
However, the phone that arrived is both BRANDED and LOCKED to T-Mobile service. I would not have bought this phone if it had been advertised as such. Purchase price was $170. To use the phone, I will now have to find an unlocking service which will cost me $25. And I may have to buy a data cable (not provided) which will cost an additional $10.
The seller has not responed to my emails. And Amazon says I can't file a claim until I try to work it out with the seller first. Also, even after that measure is attempted, I can't file a claim with Amazon until March 2006.
I have gone to AMEX and have placed a dispute on the charge. I have also sent an email to a "[email protected]" address, just in the hopes I could still get a complaint in edgewise. But other than that, I don't know what to do.
I have the name and work address of the seller, simply because it was on the package when the phone arrived. But naturally, I don't want to send the phone back to him until I'm sure I can get my money back. At the very least, I want him to cover the $25 unlocking fee and cost of the data cable.
Any advice on what to do?
Any legal action I can take to get this guy to 'fess up to doing wrong?
