What , or where can I find the procedures and guidelines for someone who is married abroad (Philippines where there is no divorce) and wants to come to the US and petition for divorce. What sort of visa is required to file the petition, ie, can she petition under a nonimmigrant visa, does she need to aquire a green card first , or what ? We are totally stuck here , any advice will be useful , thanx.

I hate to just repeat what I said on the immigration board.. but, it ain't gonna happen.. she is not going to be allowed to enter the US on a non immigrant visa. Even if she was, the divorce would take so long that she would be out of status. So, she hides from the INS and eventually you get married. You file to adjust her status. The INS gets a big, no, massive red flag waved in their faces and at the AOS interview, she is arrested and deported.

However, your going to try anyway so I suggest she marches down to the local US embassy and applies for a tourist visa. you can but try...
