I posted not too long ago because I was concerned that my ex was leaving our children home alone at night to go out drinking, my biggest concern was something happening to the children while he was gone, or him getting a DUI and going to jail while they were home alone. The conclusion was that I cannot dictate what he does with the children on his time with them, I accepted that.
Since then, last weekend my ex got another DUI and spent the weekend in jail (Fortunately, the kids were NOT with him when this happened) He got the last DUI in 2005 (After our divorce) but it was deferred, the way it was explained to me was that if he attended all meetings, and didn't get in any trouble for a certain amount of time it would be removed from his record. Well that didn't happen, so now he will have that one, and the new one.
He told me that he has to spend 30 days in jail, 6 months home confinement, and lose his license for one year.
I want to work with him as much as possible, for the sake of our children. We live two hours apart so we meet halfway to drop off/pick up little ones two weekends a month, and summer visitation, so now I guess I will be driving the kids to him where he lives, and picking them up (After jail time is over) and that is fine with me, I want my children to see their dad, and I don't want ltheir lives to be affected over this.
Long winded, I know, sorry! Here is my question, I know now would be the time to do this,
but I am not sure if it would be the best idea, so I am wondering what others would do. Should I or can I request through the courts that he CANNOT drive with the children for a period of time (He won't have a license, but that may not stop him) I just DO NOT want him to do this, get pulled over, and go to jail in front of our children.
Any and all suggestions would be great, thanks! What is the name of your state?
