could someone please explain to me what happens once you are served with papers from a collection agency..do they give you time to responde to them to see if you will pay or when you responde does it automatically go on your credit report as a judgement. sorry to ask dumb questions but my husband has to pick up papers tommorrow and we are worried sick b.c we could never get intouch withthese people and when we finally did they offered no plan. please help...

From your post, it appears you have NOT been served (as required by law), but are apparently anticipating a court filing. Your post later says that your husband has to 'pick up papers'... what papers is he going to pick up??? Since the plaintiff is supposed to have you served, why are you picking up papers??

1) 'They' do not owe you prior notice.
2) 'They' do not need to offer a plan.
3) 'They' can do whatever the law allows to attempt to collect the amount you owe.

One more thing... if they do sue you, make sure that they have the right to do so (most debt collectors are just agents of the creditor/owner, and as such, they can't take file against you.
