We are putting my dad's house on the market. He is 88 and moving to a retirement apartment. There is a tree on the property that he desperately wants to not be cut down. Can something be put in the contract with a purchaser to not cut down the tree for a certain length of time unless required by ordinance? Best with or without a reduction in sale of house?

How exactly is dad going to find out if the tree gets cut down or not?

If it really matters, put a term in the flier describing the house and any subsequent contracts, saying that if the new owners or any later owners cut down the tree before 2005, they have to pay your dad $1000.

Alternatively, rent the house until dad gets over the tree fixation, then sell it.
