If a doctor brings a patient to the lab for bloodwork after the visit with the patient, and other patients are in the waiting area and can hear what is said in the drawroom between patients/pbt's, patients/doctors per there is no door to close to the waiting area. If this doctor stands there where other lab personnel as well as patients can clearly hear with the patient sitting in the phlebotomy chair and talks/discusses with the patient she is doing a HIV 1 test, Hep C test, STDs tests....is this a violation of HIPAA on behalf of the doctor?

I wondered the same thing as the text of the original thread is nearly verbatim from a HIPAA competency test! :)
No, actually not homework....is something that took place in the workplace. Just wondering if both are violations or not a violation. Guess it's curiousity more than anything in trying to understand the law. It's a big law and alot to digest and try to keep straight. If that makes any sense.
