Thank you Lawrat for answering my question - by the way I did reply on my other message with a question - just to add to it - I have never sued anyone in my life nor ever been treated as bad to by anyone ever. This is the first and its a shocker to me - I always think these are the things that happen to the next door neighbor or in the movies and now it happened to me and it makes me feel very unprotected or I should say vulnerable is more like the word. It makes me wonder too if this will be one of those - the good guy is right but the bad guy wins anyway - I have been having a series of bad luck in my life lately miscarriage on Christmas, surgery in January, accident in March, daughter had surgery 2 weeks ago and now this. So it kinda makes me feel by some unknown reason favor will go to these bad people even though I was the stupid fool who trusted them with my money in the first place and got taken for a ride. I have kicked myself a thousand times for trusting these people - this incident has shattered not only me but my daughters as well because they were with me when we purchased the machine and were all excited about me sewing their easter clothes now I don't have a machine to sew their easter clothes and the materials are sitting there and my oldest (8 year old) is all confused and angry as to how come these people did these things to us and what have we done to deserve this when we serve God and do the right things, help people and take care of other people. It's amazing how an incident like this can turn one's life upside down and inside out and cast so many doubts as to what we really believe in. Is there really goodness in people, can we trust other people aside ourselves, my husband has come to the conclusion we can't and is very bitter about this whole situation. I for one am holding on to my faith and believe that somehow God will help me through this - maybe it is to show these unkindly people that altbough I may just be a churchgoing mother who they see as a weakling can stand up for justice and still forgive them if they are willing to apologize and make things right by abiding in good business manners. I am even the type to recommend business people to other people when treated right. I thank you for listening to me - as you can see this is occupying my mind so much.

You indicated that if I can show they intentionally misled me - this is kinda hard the guy who sold me the machine demo the machine and I liked it I decided to buy it wrote the check for the machine together with the price for vacuum repair. He came back out and said that they are out of stock and offered me the demo unit I said no I want a brand new one and he said "Can't blame you" and then said that he had to order it and it can be here in 2 days. When I was asking for my money back he insisted now that I cannot have my money back because it was special ordered - would this be the case if they have the machine in demo? Secondly, I only had 1 check with me at that time and when he right away said don't worry I can have the machine for you in 2 days I trusted him and gave him the whole check instead of voiding it and coming back again for vacuum and sewing machine and this is where my mistake began. You see he was professional at that time, even joked around with my kids and made small coversations with them, my kids felt at home talking to him and it didn't give me any indication not to be able to trust him at all. But when I called to follow-up on my machine and was told first it was coming from Denmark then on another call from Chicago that is when I got suspicious and decided to do some research in the internet about this machine I bought and found out three other companies are selling it $100 less one of them their own branch office. Everything was done over the phone and searched on the internet only one company show the price on the internet while the others were over the phone including their own branch. So how can I prove this?
2. As for the owner and his uncle cussing at me there were no witness other than one of them is their own people who I don't even know the name so I can't subpeona and besides he'll never side me and testify against his own boss cussing at a customer.

As for the uncle threatening me with their dog, he literally went to the back and brought his german sheppard as far as behind the counter to scare me I backed off the counter but still refused to leave the shop till he settles the problem and that's when he called the cop on me. No witness again. I told the cop what happened and right away he lied to the cop and said no its not true - so this already tells me that he will lie in court and not tell the truth or admit to the truth of what happened. So what can I do about this as far as proof is concerned? See why i am thinking bad guy will win? I have no witness to testify against their monstrosity other than my own words against theirs. And honestly speaking when I am being attacked like that I just clammed up I remember just begging them yes begging them to give me back my money because they know they already had me for a fool.

I was expecting the owner to be there so I brought along a tape recorder to make sure I can get them on tape if they cussed at me again. I had the tape recorder in clear view and also this time I brought my oldest daughter with me as my witness. I had intended to tell him the reason why I am taping our conversation but he started talking and the rest is history there was no verbal part of me telling him why I was recording our conversation. So he later said he can sue me for recording what he is saying - can he? How it happened is I walked in he came from the back saw me and proceeded to say "I don't know what happened between you and the owner yesterday nor what happened at the other branch but I was told to just give you this machine." I told him that I do not want the machine I want my money back and he then again said "My instructions were to give you this machine pointing to the box that was opened and taped over and if you refuse to take it, to ask you to leave and if you refuse to leave to call the cops again on you." As he was saying these to me I noticed his hands were shaking. And I think to myself this guy is not the bad guy its the owner and the uncle who cussed at me are the ones. They are the greedy monsters who will take every penny from a poor old lady for their gain. I am not saying that they should sell me the machine at no profit business is business we do business to make money but when you know that three other companies are selling it for $100 less and they are making profit already especially one of them is their own branch then don't you think its outrageous that they are taking me for $125 more on top of what they are already making profit on? Besides I wouldn't have found this out if they didn't keep telling me lies about in 2 days I'll get the machine or now its going to be a week because its coming from Denmark then from Chicago - now I can really call myself idiot if I still didn't catch on that they are taking me for a ride after the third call - no machine!
5. On top of all these they also threatened me that if I don't pick up the machine in 30 days from date of purchase I lose both money and machine - I have no written contract to this effect. The only thing I have is a ticket with their company name on it, a claim number, their company address and the statement CASH ONLY and a hand written Paid in Full on it and an adding machine tape showing the price. So does his statement of 30 days lose money and machine hold?
