FYI - Im in San Jose, CA

Before moving into my current apartment complex (2 story townhouse community) I asked the landlords if it was possible to have DSL installed because I work from home and need to do heavy file transering (I do graphic design for print) They told me that would not be a problem - HOWEVER - my local phone company "Pac Bell" told me I was to far away from there box so I wouldnt be able to get ADSL over the phone lines. I tried "XO Communications" and they originally told me I could have SDSL but then when they tested it said it wasnt possible (to far still). I finally found "Reality Wireless Networks" who said they could do XDSL (wireless) but would require putting an antenna on my roof. I asked my landlord if they had roof access somewhere and she told me I am not allowed to put an antenna up because of "insurance reasons" (sounds like bull**** to me - much like there "no smoking OUTSIDE policies" smoking inside is alright)

1) Can I still place an antenna on my roof?

2) If not can I get out of my 6 month lease without paying the "cancelation fees" because they lied about DSL availability in there complex?

3) Any advice or legal advisers want to help me out PLEASE let me know.

If it was a written promise that DSL was available in that area and management was mis informed that would be your only way of ``getting out of it `` now If you had to are you willing to have the dish inside your unit aimed / and parked smack dab infront of a window ? that is in right direction to get signal ? Other wise see what your landlord is concerned about is likely roof damage from a install . Wich is a valid concern . With out my consent I have had tenants who installed dishes and did such a crap job that it caused roof leaks . so If you can find a way to install a dish in the unit it self aimed through a window (but inside your unit) where you still get signal that may be option for you . I have had phone line DSL at one home , moved to a rural area where satelite Net was only way to go faster . then local phone co here finally upgraded to come out 8+ miles with Dsl now so I switched again :) one other way to do this is to see If management can allow you to have dish professionally installed and agree to leave the dish behind when you do move (in writing ) reason to suggest to them is if they ever have another tenant who wishes to use it it can be used and there wouldnt have to be another install OR last See if the company who was offering services to you will negotiate with landlord a commision set up for additional users brought to them and then a multiple user head can be installed so one dish would do all . ( I know my post was long ) LAST yes I know dial up bites :)~

Cable actually isn't offered in my area and for dial-up it would be impossible to throw 20+ meg files back and forth for proofing over say a 56k (even if i used the diamond shotgun 112k with 2 modems/phone lines i would still get a transfer of around 10k/sec) the slowest I could possibly go is 512k - 256k would cause me to start loosing a lot of time but could technically work. Keep in mind I used to pay $300 a month for a dedicated 1.7mb connection at my last apartment which is 2 blocks downthe street from where I am now.

They didnt have anything in writing

As far as the install - it would be the XDSL company doing the install NOT me so it would be "professionally installed"

I took a look around and came across the an FCC "Title 47-Telecommunications" act passed in may 2001 which staits that I can not be hindered if I wish to install ANY type of dish/sat/antenna on my rental property/house/apartment/town house/condo etc...

Does FCC law and CA law conflict on this? I cant seem to find any CA laws on this any help/comments are always appreciated.
