I live in the state of NJ. I married a man about 30 years ago and after 2 weeks, he went out for cigarettes and never returned. I never saw him again, and I do not know if he is alive or dead. I wish to remarry but do not know if it is more economical and quicker to get an anulment vs. a divorce. I was wondering if I even qualify for an anulment based on the brief marriage.

Also, can I go through the annulment or divorce process without knowing his whereabouts?

My response:

Um, I've got news for you . . . you didn't have a "brief" marriage. You've been married for 30 years !! You lived together briefly, but that doesn't change the fact, that in the eyes of the law, that you haven't been married for 3 decades.

Anyway, you need to obtain a divorce. He doesn't need to be around, either. Your attorney will "publish" the Summons, and when your husband doesn't respond, you'll obtain a "default" dissolution of the marriage.
