My boyfriends father went into business with a two friends, opening a pest control business. They hired my boyfriend, only paying him $120 a week salary. He was later promised a raise to $200 a week salary and quit his second job to devote to the company. This raise never happened. They bumped him up to $170, but never increased his pay to $200. That was over 8 months ago. They don't pay him enough for him to be able to purchase a vehicle so he's worried about leaving. I've told him they violated salary law requirements (meaning, I believe you have to make $400 a week to be salary), but we don't really know where to go from here. His father's health is failing and has been in the hospital for over a week and his business partner is using this time to make machavellian (Sp?) grabs for power. In addition, the company has an unlicensed person working for them in exchange for room and board but no matter how hard he works he rarely sees a dime. Both my boyfriend and this man are often not reimbursed for work done on the vehicles or gas. Please any advice. We are willing to sue, even if it means his dad never speaks to him again. we just need to know how to re-coop some of our losses.

PS: Oh, and the guy handling all the office stuff didn't take any taxes out of my boyfriend's pay and now he has to shoulder both sides of the tax burden when he's only making $680 a month for up to 40 hours worth a work a week. Please help, we are desperate and drowning here.

To be considered EXEMPT you have to be paid a minimum of $455 per week. But not all salaried positions are exempt and not all exempt positions are considered salaried. It is possible to have a non-exempt position that is salaried, and a non-exempt does not have to be paid $455 per week.

However, a non-exempt employee, regardless of whether they are paid by the hour or on salary, has to be paid according to minimum wage and overtime laws. It COULD be that they are within these laws, but only if your boyfriend is only working a very few hours per week. How much time is he working for them?
