My son turned 18 Jan 1st of 05. He dropped out of high school in Feb. of 2003. NC threatened to take away his DL so he enrolled in a community college adult education program. This is no longer relevant as he is 18. He received 7 credits in the last 2 years. Last November my son moved in with me in TN and NC stopped his child support. I was adamant about him going back to school and he got mad and went back to his mothers in NC. I just received an order to appear in court as she wants to have the child support reinstated. She claims she has re-enrolled him in the community college. According to his transcripts he needs 3 English credits and 1 Algebra credit and several test make ups. What are my chances of winning this?

Your question is vague--are you asking is there anything you can do to get out of paying the child support?

Probably not much chance of that, but at some point you should explain to the judge that you would prefer paying for some type of tutoring assistance for your son to improve his academic skills. Seems odd that the school would let him back in if his grades were so bad--shouldn't he be on some type of academic probation or suspension?

It looks like your ex-wife is putting him back into school just to have the financial obligation of a bill to pay but it's not exactly clear who is responsible for paying this bill--her, you, or both of you jointly or if there is some other option. Have you considered talking to the financial aid office to see if he qualifies for any type of grant or tuition assistance?

Be responsible and pay the child support but I don't know what the solution is for son's failure to perform academically, or get him to move back with you. Make sure the court also knows that he got mad and moved because of his rebellion against your parental authority--is there some other type of job skills program/learn a trade that he would be interested in besides community college? Find out what the legal age of adulthood is so you will know when your obligation ends and he will have to find out how hard it is to live in this world as an adult.

The adult education program GED is free. I have paid my support for 18 years and have no problem paying it if I thought he would stay in school. He has been in this GED program for 2 years and has only received 7 credits. His grades are very good he just doesn't go. The community college in NC has no set attendance gudelines sort of set your own pace enviroment. You made a good point in the tutoring fees. Thanks1

Thanks for the clarification. Why doesn't he want to go? Is it laziness, emotional turmoil because of the divorce, or is he being used as a pawn by ex-wife to make you look bad and torment you?
