this is a difficult situation. my father passed away with a settlement he had won, from workers comp. my father passed away before he recieved the check. my father did not own any thing, but the money that was coming to him from workers comp. i am his daughter, do i still have a right to that settlement. i am married and did not live with my father. am i still a dependant?

my father's lawyer is avoiding my phone calls. he told me if the state was to find out my father was deceased then thier would be no settlement. i don't know if that sounds right. i recieved a letter on july 18 th, that claimed the check was at the state to be signed. i called the state, but did not tell them my father had passed away. i asked them how long it takes once the state has the check. they told me 25 days. i don't know if i am recieving the check or if the state is keeping the check. my father was also on disability and ssi, but his payments stop once he get's the lump sum. his payments have stopped, but i don't know if it's from the check or his death. should i hire another lawyer that deals with complications like these? i paid for my fathers funeral and did not have the money to do it. i was hoping for the check, so i could pay off the funeral. what can i do?
