I live in Texas and my apartment complex changed the required notice before move-out from 30 days to 60 days. The problem is, I have attempted to move to another complex, but every other apartment complex only requires 30 days notice. What this means is, they also do not a)hold an open apartment for more than 30 days, and b)usually do not know who is moving out 2 months from now (since they only require 30 day notice). I feel like my apartment has me in a jam. It would be stupid for me to submit my 60-day notice without knowing if I will have the particular apartment I want available. If I give a 30-day notice, then I get stuck with paying market rate or higher for one month (which is about $200 more than what I pay now).
Do I have any other options? Is it legal to require a 60 day notice?

The landlord CANNOT change any of the terms during a lease, so if YOUR lease says 30 days then its 30 days.

happy lucky is correct when he/she states that the landlord can not change the terms of the lease agreement once the lease has been signed by both parties, unless somewhere in the lease agreement there is a clause stating that the leasor reserves the right to change the notice to vacate terms with proper notice to the leasee. Take a good look at your lease agreement!

Thanks for the replies. Just to clarify, the rule was not changed mid-lease. I have been in this particular complex for 5 years. The policy changed a year or so ago. Thanks for the feedback.
