Well my situation is somewhat simple, with a minor stickler. Almost 2 years now I was an an accident in Queens, NY, where I, the driver, was in a car and had to come to a stop on an expressway due to a car stopped in front of me. As I was sitting and waiting for an opportunity to merge in to the right lane and continue my trip, the driver in front of me began honking her horn and pointing behind me, as I turned around to see what she was pointing at a van came barreling down upon my vehicle. Just as it was coming upon me I lokked around for a way out and turned back again just as the Van collided into my vehicle. This pushed my vehicle forward, but I was narrowly able to steer the vehicle to the right and avoid colliding into the car in fornt of me. I think this was more to avoid injuring the children in the back of the car in front of me than damaging their car. Anyway things went blank for a short moment and the next thing I knew a contruction worker was banging on the window yelling to see if I was ok.

Ok, now here is the complicated portion. The car I was driving was a friends, and it just happened unknown to me that he was having problems with his insurance company so when the medical clinic where I was receiving therapy put in for a claim it was denied. Since I was and am self employed and without insurance, the medical center adviced that I only seek therapy when it was absolutley neccessary since it would be difficult for me to pay. I thought many times to seek a lawyer, but then I was in a catch 22 because being self employed, all the time I had taken to rest and rehabilitate caused me great financial loss that my family couldnt afford. So I did what self rehabilitation I could using the exercises from the clinic and continued trying to work.

The injuries I sustained were 4 bulged disc, kneck and some upper spinal which never had a final diagnosis due to the cost of the mri. I had always thought it neccessary and recently began thinking even more of trying to get back to therapy because its hard for me to sit in a chair and work at the computer which is how I earn my living.

So with all of that said and adivce would be greatly aprreciated. I would also like to note I have all the documents from the accident including the police report if that is of any help.

I know that New York has a no-fault approach, but it would be wise to see an experienced injury attorney asap. All states have statutes of limitations and if it runs, any claim you have would be barred regardless of its merit. Don't prejudiced your rights by any further delay. To find a lawyer try to a find a lawyer who is a member of the American Trial Lawyers Association (ATLA). They also have a find a lawyer page at their web site at http://www.atlanet.org
This organization is the premier national plaintiff's trial lawyer organization. Although membership is no guarantee as to the lawyer, on the other hand, in all my years, I have never met an excellent plaintiff's trial lawyer who was not a member and who not had been active in either their state or national organization. Thirdly, also check for a lawyer who has been certified by The National Board of Trial Advocacy. Their web site is at http://www.nbtanet.org/ . Although both plaintiffs and defense lawyers can be members, each member has been nationally certified as a civil trial specialist by passing tests and by having tried a specified number of successful civil trials.

OH well i think you might be screwed due to the fact it has been 2 years...

You should have immediately hired a personl injury lawyer, and sued BOTH your friend for not having insurance and the driver that hit you.

Also since you REFUSED medical treatments, no insurance company is going to pay for any damage they cant prove.

As always there are plenty of FREE lawyers willing to talk to you, so get off your butt and start looking in the yellow pages.

Peter, I never said I refused treatment, in fact I was in treament for a year, but since I had no unsurance and was paying out of pocket, it was not possible to continue.

As for a lawyer I had at that time contacted several lawyers who at the time stated that I needed to remain in therapy to determin the extent of my injury and build a case.
