On Sat., September 14th I purchased a used 1990 Honda Accord. While looking/test driving the car my husband noticed that it had an oil leak. Though he pushed, I informed the salesman that I would not be purchasing a car that had an oil leak but if they were willing to fix the oil leak then I'd take it.

At that point the salesman brought his mechanic out to look at the leak and the mechanic quickly looked underneigth and said "it's the oil pan seal - I'll fix it!". I bought the car "as is" with "fix oil pan seal" INCLUDED in the contract and made an appointment for them to fix the oil pan seal on Monday Sept 16th.

On Monday, September 16th I brought the car in for it to be fixed. It was at this point that the salesman asked me if I had hit a curb or something because there was a big crack on the bottom of the oil pan. I told him "that must be the same leak because I hadn't even driven the car". The mechanic assured me that he would fix it because "it was like that when you bought it" and told me until then not to drive it because heat + crack is not a good thing. They also said they will need to find an oil pan. They told me they'd call me on Tuesday, September 17th to make arrangements for me to bring the car in for a full day to change the oil pan.

Tuesday came and went and I received no call from them. I called them on the morning of Wed. September 18th and they said they were searching for an oil pan and they'd get back to me.

It is now Friday, September 20th. I have no heard from them. The car has been parked for almost a week now and I have a feeling I'm not going to get anywhere with them - especially because they were wrong in diagnosing the problem so therefore my contract is wrong and legally they don't have to fix the oil pan - just the seal that doesn't even need fixing. Is this right?

Any recourse in this situation?

You must allow the dealer time to remedy the problem, say about 30 days. You are not entitled to any refund if that is what you want. The car is far too old for any of Washington's lemon laws to be valid.
