I was told that I had an ulnar nerver compression in my elbow and at the same time the pain was raidiating up my arm into my shoulder and while I was being treated for 2 years with shots of cortizone - my doctor then operated on my elbow and left the shoulder alone. I was back to work in 6 weeks but and a year later was determined to have a 20 percent ppd. The elbow is still not right but better .. 1 year later they addressed the shoulder which was giving me pain still and they did and MRI to show a rotator cuff tear and an impingement now I had surgery on that 6 weeks ago. However my question is NY comp says they are not going to pay me because my 20 schedule ppd was for both elbow abd shoulder.. How can they schedule a shoulder they never treated ??????????????

Did you talk to a lawyer? Also you said 2yrs of cortizone shots? how often were the shots? were all they all in the same spot? your only aloud to get 3 cortizone shot in the same area in a lifetime cortizone helps with pain but it breaks down muscle and tissue and can cause some serious injurys

I did not talk to a lawyer yet I was going to represent myself again.. I had 3 shots in both the elbow and sholder within 3 years . When they scheduled out my elbow a year ago my work insurance company is saying it was also for the shoulder because it was on the same WCB case number but the shoulder was never operated on and was still being treated until Jan 7 of this year they went in an operated
 
For over a year and a half I have fought with NY w/c lawyers and you get nowhere real fast. My right wrist was orig dx with sprain. Not the case. I went to my doctors and was dx with carpal tunnel, cubital tunnel and cervical stenosis. w/c would only approve surgery on nerve going to thumb and pointer finger. No difference. now after all the p/t my doctor says that the ulner nerve needs to be operated on to release it. The pain is all the way up to my neck and my arm feels like it is burning off my body. I have been sleeping with a brace at night that is so uncomfortable and actually makes my arm feel worse. Point is that somewhere along the line w/c probably approved your shoulder with the elbow or they wouldn't have put it on the same WCB #. My doctor has made sure to only work on one part of my arm at a time. Sure taking longer but w/c is paying for the whole thing. I also have a very good lawyer. I would try that.
