I signed a 1-year apartment lease agreement in effect from 6/1/99 to 5/31/00. I received notification that if I did not execute a new 1-year lease by MAY 31, 2000, a month-to-month lease would automatically be in effect. I want to move out at the end of the agreement I thought I was obligated to: 1 year. The original lease agreement does state that "This Agreement or any extension thereof may be terminated at the end of the lease term by either party provided written notice is given to the other party. All notices are effective 30 days after the first day of the month immediately following receipt of same." If my signed lease was for 12 months, how can I be automatically committed to 13 months? My only written notification from them was to act BY MAY 31 to avoid going month-to-month. I tried to give 30 days notice on 5/12 to accommodate them and move out by 6/12. Am I liable for June's rent of $1200 even though I haven't agreed to a new lease??? PLEASE HELP!

Visit the landlord/manager and ask if they think you are obligated beyond 5/31 if you're gone by that time. Get their answer in writing. Make sure they know you don't want to stay beyond 5/31. They may have interpreted your 30 day notice as a request to hold over until 6/12. Write again if you don't like the answer you get & we'll give you more advice. :)
