My husband,daughter and I currently rent a apartment in Florida. We want to break our lease due to the high crime in the area. Recently we found and are in the process of buying a home in a nice neighborhood. We would like to negociate with the apartment complex about our terms stated in the lease.i.e. Paying a additional $200.00 on top of the original $200.00 security deposit as well as a $300.00 pet deposit..Also for a moving special they gave us $300.00 off our rent that they want us to return. Can we negociate? We our very good tenants and would like some suggestions or advice. Thanks for the help,Tenant waiting in Florida

You can negotiate, but there are no legal grounds for terminating your lease, unless the crime is so bad that the entire apt complex is completely uninhabitable. Ask if the pet deposit can be applied to the rent rebate they gave you, if they inspect & find no pet damage.

Your other option is to demand in writing that L do something to make the complex safer. This may include: evicting tenants who cause problems, fencing the complex, installing security lighting and/or cameras.

OK first, most places are reasonable with respect to home ownership, but the $400 deposit you paid forget about it! breaking a lease is serious....so unless they rent the apartment the NEXT DAY then its gone, because the landlord CANNOT charge 2 people FULL rent on the same apartment for the same month if he does then you can sue him for the difference.....

Pet deposit.....well YOU hire a carpet cleaning service and then take lots of pictures.....get 2 or 3 disposable cameras, and make 2 or 3 extra copies of the prints whats that $50 total... thats just to protect your ass in case he says the carpet need to be replaced...

Now the $300 move in special......that you have to give up.......no way will ANY judge ever give that to you unless you are dying.

You signed a lease you didnot finish it..PERIOD end of story...the $300 is gone forever..
