My Pennsylvania lease expires 9/30/00. However, I must move out by 7/8/00 because of employment relocation. I notified the rental office and asked that my security deposit be used to cover June rent. The office responded with a letter stating I must pay for June and the remaining months rent. In my lease it states the landlord may use the security deposit to pay for losses or damages caused by tentants breach of the lease. Can I be charged for the remaining months? Also if I receive an eviction notice for non payment of June rent can i still be made to pay for the remaining months?

If you've already moved, you can't be evicted. However, you are liable on the lease contract for rent until 9/30. L has to try their very very best to re-rent the apt ASAP to "mitigate" L's damages. Unless the rental market is odd, L should be able to re-rent by the end of July.

L does not have to use your security deposit to cover the rent. After all, how can L know how much will be available until you've moved out & L has inspected the place?
