I had this really important package from FedEx (fabric for my wedding, coming from Scotland) delivered to me at my apartment but since I wasn't home they left it at the office. I do not ask to have it left there, but the apartment complex tells delivery services to leave it at the office instead of leaving them on your doorstep. Since it was an international package, it required a signature. So, one of the office workers signed for the package but she didn't actually see the package. What happens is the FedEx guy brings the thing in to be signed and then he puts the packages in this closet. The office people never actually deal with the packages. Instead, they keep the packages locked in that closet until people come by to say they have a package. So, when I got home I checked the online tracking for the package and saw that it was delivered and an "R Smith" signed for it. I went to the office to get it and it was no where to be found (and "R Smith" didn't remember any specific package). So, for the rest of the day I bounced back and forth between FedEx and the office in search of this package. I eventually got FedEx to check the local warehouse (where they did not find it) and call the man who delivered the package (who says he put it in the office). Since it has been signed for, FedEx considers it delivered and they are no longer responsible for it. So, I told that to the apartment complex manager and she said that it says in our lease that they cannot be held responsible for packages delivered to them. I have found the clause in the lease and it reads like this:
"Services Rendered By Lessor
Lessor will furnish janitor service for the removal of garbage in accordance with regulations and at times set by Lessor from time to time and for cleaning of grounds, walks, entrances, parking spaces, and other portions of the property outside the apartment of Resident. Such activities shall be conducted at such times and under such conditions as may be prescribed by Lessor. If any employee of Lessor renders any other service (such as parking, washing or delivery of automobiles, handling of furniture or other articles, cleaning the rented premises, package delivery or any other service) for or at the request of Resident, his/her family, employees or guests, then for the purpose of such service, such employee shall be deemed the agent of Resident, regardless of whether or not payment is arranged for such service and Resident agrees to relieve Lessor and hold Lessor harmless from any and all liability in connection with such services."
Since they really have no form of security for these packages, other than locking the door and making people _ask_ to have it opened, it could have easily been taken by another resident in error or simply stolen (they will be sorely disappointed to find a bunch of wool fabric -- fabric for the ring bearers outfits sent from Scotland). But it has me out of about $125 plus making me crazy for the past few days.
Is there anything I can do?
Thank you,
Alison Symes
