Apartment Management says they CAN'T FIND MY LEASE?!?

I lived in this apartment complex from August of 03 to August of 04.

Before I moved out I was told by the management to NOT call the gas company to have them discontinue my service. Management said that they would take over the account on my move-out date. I did exaclty what they said.

A year later when I try to start gas in my name at a different address the gas company says that I owe them $140. I inquired what dates and they said for August of 04 through Feb of 05, the dates after I had moved out of the apartment.

I went back to my old apartment, which was now under new ownership, a new name, and new management. They were no help. I called the group that used to own the complex and they said that they would take care of it. I called the gas company and told them so they started my gas service.

I recently ran a credit report on myself and found that I had a collection out there for $140. I knew what it was for and called the gas company back. They said that nothing had ever been resolved and that if I don't fax them a copy of my lease showing my move out date then I would have to pay the $140 or have my service discontinued.

I can't find a copy of my old lease. When I call the people who own and manage the company now they said that they don't have the old leases. When I call the comany that used to own the complex they said tha they don't have the old leases. I have found out that SOMEONE is supposed to keep them for seven years. All I need is a copy of the lease but everyone keeps pointing fingers at each other. If you go back seven years and count up the number of leases that SOMEONE should have it totals around 10,000 leases. How could yo misplace 10,000 leases?

My question is this**************Who can I talk to if no one can produce a copy of my old lease? I would like to turn these people in for not following the law and keeping these records for seven years. Who can I contact to turn these people in or who should I tell them that I am going to contact for them to understand that I am serious about this matter?

*you* are the one who should keep a copy of your lease. I don't know that any other person or entity would be required to give you a copy in this instance...

Apartment renters are required to keep a copy of all leases for seven years after they expire. I am being told by both the former owner and the new owner that they do not have them. Who should I contact to turn these people in for clearly breaking a law regarding rention of old leases?

There were 2500 tenants at this complelx. This complex is rented per room, not per apartment (it was a student apartment complex). Company A sold the company to B in 2004. That would leave 10,000 leases that should be somewhere from Company A. Company A and B both say that they do not have them.

2: Explain how that requirement somehow obligates them to provide a copy to you...

This means YOU are required to keep a copy of all leases, etc....RENTER is YOU.....

It is doubtful that there is any requirement past the those required by the IRS which is 3 to 5 years...for business records.

Since the old LL is still in business, write them to SEND YOU the $140 within 10 days or you will sue them in Small Claims court. Send a copy of the letter to the gas company.

Let the old landlord explain the situation to the judge....next time, make sure you call any service/utility companies and take service OUT of your name and arrange to pay the final billing.:rolleyes:

Just out of curiousity will your gas co accept print outs showing the date you changed electric/ cable/ telephone ? If you changed your state Id to right away will they accept a print out showing the date your application was made if such info can be given to you by the motor vehicle dept?
