Apartment on Fire

What is the name of your state (only U.S. law)? NJ

Just yesterday my mother's apartment burned down. The apartment is located right above a restaurant that caused the fire. Thankfully, no one was injured or killed. My mother's apartment was severely destroyed, more than the others.

I went to ground zero this afternoon, and I found a bulldozer taking down the apartment from behind. The left side of the building was unharmed due to a firewall protecting it. The right side, where my apartment was, is completely gone. I doubt that she will be able to recover anything from the rubble.

What really made me mad was when I was told about the firemen and their ignorance. I was not there, but according to the story I heard, the firemen had to be called in by another tenant as the building's fire alarm was not functioning. They came about a half hour later. After they came, it took them another half hour to find out how to open the doors to the restaurant because they did not want to smash the windows. They went to the owners house to ask for the key...while the building was burning. I was told that they could have saved the building, they didn't even begin spraying the building down immediately and waited for about a half hour.

I also can't help but think that there was some kind of mafia involvement or that the house was burned for an insurance settlement. We do not have home or renter's insurance. It is likely that the owner will be getting no less than a million dollars in insurance money, while the tenants will not receive a penny.

I can understand if it was our fault, if we has started the fire, but that is not the case here. We are paying for this because of the restaurant. Now I'm not sure how this works, but I need to find out whats going on and get to the bottom of this. Anyone have any tips to investigate this matter? Also, should I attempt to contact a lawyer to possibly help me with this case? I just can't rest until we are compensated for our loss, especially since it's not our fault and that we lost everything. We just bought new furniture, a nice 50" plasma with a Bose sound system. A ton of jewelry which include gold and diamonds. My mother is in very bad financial shape now, all of her savings was in cash which all got burned. We did not have any type of insurance to cover all of this.

My point is, I am here to ask if there is anything I can legally do to be compensated by the restaurant or the building owner or even fire department for their ignorance? The fire alarm was not functioning, there is a great possibility that it was turned off by the owner ( I know this for a fact, but I'm not sire how I can prove this). Who are the people I should talk to, and what should I say?

Hearsay. In any event - in a structure fire the firefighters typically gut the walls and all the insides including ceilings and the roof in order to find any hotspots. I'm not defending anybody here, but their duty isn't to protect your stuff or the structure- its to save lives and keep it from spreading.

If it was the LL fault you may be able to get compensated for the new items you purchased as I am sure the stores you purchased them at will have records of the sales...as I am guessing the "receipts" were burned up with all the valuable jewelry and cash.

Proving the diamonds,gold and cash may be more problematic, I cannot advise you on how to prove that as I am at a complete loss as how to proceed on that one.

I have to ask...with all these valuables in your Mother's(or yours??) apartment...and since there was a lot of cash stashed there...WHY did you (or your Mother) not have renters insurance??

I am guessing you will be asked that question, given all the valuable stuff you had in the apartment.

As far as investigating the fire, the fire dept.,the mafia etc....Good luck with that.

It was my mother's place, and I don't think she thought about getting insurance on an apartment. It wasn't like there was a million dollars worth of stuff in the house, but it was everything she had. I am hoping for at least a $15,000 reimbursement from the restaurant.

In the future...do not underestimate how important renters insurance is.It not only replaces the burnt up items it also would now be paying your mother at least 150% of her living expenses(she had when she lived in the apartment) to house herself somewhere else while she sought another place to live.

Be sure she gets it for her next place.

Another testimonial for tenant insurance. There as losses all the way around. Hopefully the fire department will rule it an accident and all can move on.

Every lease I have seen in the last 20 years has required renter's insurance. You should have bought for mom for Xmas....if she has belongings, she needs insurance.

Restaurant insurance won't cover her items nor will property owner's coverage.

Depending on the actual cause of the fire, the restaurant may have a GL policy which could afford some coverage here. First thing to do is get a copy of the Fire Marshall's report and take it to a local lawyer to see if there's any recourse against the restaurant. (There doesn't sound like any for the LL, much less the FD).

It is always somebody fault, except your own....everyone should have insurance, no excuse.
And fireman are not ignorant, you must remember they put their lives on the line for me and you, they can not help if the fire alarms don't work and another tenant had to call in, how does that make them stupid? Being an half hour late does not make them stupid either. Think about the whole process of receiving call, getting everyone together, hop in truck, fight traffic and get to destination....could you do something like that in less than 30 minutes? Even a 15 mile drive takes close to 20 minutes travel time....

Like everything today, everyone cries lawsuit for one thing or another...fire department probably had a legal issue about an owner suing them for damages to his business by breaking windows, etc., even thou a full blown fire was destroying the his place..you never know..like you, wanting $15,000 when you should have had renters insurance, no one fault but your own...

Sorry that you had everything lost..take care..

Be very careful who you say this to. If it gets back to the owners of the restaurant, you may need to seek advice from quincy on the libel/slander forum.
