apartment say i owe money!! help!

i have a very interesting situation now, my husband had an agreement with the apartments we live in that he would work ten hours a week for them and that would cover rent. the original lease we signed never states any amount in it, where it was supposed to say how much our rent was instead it said"n/a"or" see attached" and the "attached" was a paper with the agreement that says he will work and they will provide him with enough hours to cover rent . well long story short he joined the army and my son and i got evicted, i am moved out now, but they are trying to say we owe them over 1,300 dollars. my question is this the court papers they sent me say
"persuant to said lease you owe..." but the said lease never says how much rent would have been if he didnt work. so can i fight them on this amount?

How long were you living there without any work being done ?

You could try to fight it but the court will look at what's fair and just .

If you tally up what the rent amounts would have been during the non work and it equals their demand , they may or may not prevail , since there was no amount listed .

Why not consult a local landlord/tenant Attorney for 50 bucks .

thats what im saying, there was never an amount EVER in writing, so how are they coming up with that amount? it will basically be my word against theres? i cant afford 50 bucks i have no money ( i have another post under the military law section, explains more)

BL asked you How long you were there with no work being done, It does make a diff how long you/ you and hub lived in the unit AFTER the work that was supposed to occur weekly was no longer being done. SO just how long after hub stopped working for them did you or he occupy the apt? Even if a amount was not listed you have to think about it likely the LL is basing the claim according to what the rent value would have been if you were paying customers. so how long did you stay on ?

we lived there for about a month or two without work being done,and as soon as they found out he joined the army they evicted us. but what im saying is how can they say their suing me, and they actually tell me to look at the lease and theres nothing on it. what are they basing the amount on when we never signed anything saying we would pay that so-called amount, that basically means that they could say rent is $5,000 a month, and now we have to pay.:confused: :confused: :confused: :confused:

Well I'm sure if this ends up in Court management will tell the Judge the amount is based on comparable rents , or what the rent would have been .

Could you get off on a technicality ? Only a Judge could decide .

You are not covered by hubby going into the military .

Well there you go, just put it off till later. Maybe it will just go away over time:rolleyes:

It was an apartment complex, they will use the same amount of rent they get from the other apartments that are the same size as yours.

in answer to the first piece of "advice" , no, i am not hoping it will go away, what i meant was that i need to focus on finding a place for my son and i to live,doing nothing but constantly thinking about it will only stress me out more. i do realize this as a problem that needs to be dealt with. and for the 2nd piece, thank you for your input.:rolleyes:

You really don't have time to deal with it at a later time. If they get a judgement against you they will attach your husbands pay.
