etc.
1.Does the use of surname "Stallone" violets rights of Silvester Stallone?
2.Can i use music for game under Creative commons license (CC-BY)?
the game is commercial.

You can not use the names of famous people without their permission.

CC-BY can be used provided you follow the guidelines that the author put down for giving him credit (CC-BY doesn't stand alone, it has to have additional information).

This has nothing to do with the app store, this is the law for anything.
