Appeal of EDD decision/supoena of docs

My employer appealed the EDD decision to grant me unemployment insurance benefits. The employer prevailed, and I am appealing that decision now. The appeals board has allowed me to submit new evidence for review at this hearing, but my employer is refusing to provide a copy of their attendance policy for 2006 and 2007, which I will need to establish that I was not guilty of misconduct. I have no access to those documents now as I am no longer an employee and cannot access their website.

Can I force my employer to provide these documents ? If so, by what procedure ?

The only issue here is my ability to qualify for unemployment benefits. The EDD initially said I qualified and paid me benefits, which I may have to reimburse to the state if I cannot prevail in this appeal. I will most certainly need a copy of the attendance policy to do this.
