I live in Idaho. I have primary custody of my daughter. I just found out that the reason her mother has not been taking advantage of her visitation rights is because she has moved far away to New York (without telling me). In appendix A of our court papers for visitation rights, it says that we are to not relocate outside of a 100 miles radius - which she has obviously done. Since she broke appendix A, am I free to move? I want to move to Texas. What actions can I take?

Submit your request through the proper procedure. If she contests the move, it is unlikely she would prevail in fighting the move in court under the circumstances. But that way you have covered your backside.

I'm in Texas and have a living restriction put into my court order, but if the NCP moves out of the restricted area than I can move wherever I want. I would imagine that is how the court will see it in your case, but go by the book and move!
