I have been married for almost 17 years. (Cohabitated 6 years before that) I just filed a petetion for divorce in the state of Arizona. Am I entitled to the appreciation of seperate investments? I found a case law: N.Y. Spencer vs Spencer A.D. 201 646NYS.201674 (1996) which stated, "Funds inherited by husband were his seperate property, BUT...increase in value of the funds due to his management of his investment WAS MARITAL PROPERTY." There is a HUGE disparity of income between us. Two weeks ago I was given a Marital Settlement Agreement by my soon to be ex-husband. It was a slap in the face! After consulting with three attorneys, I was advised to file for divorce. As it is, I will have no other alternative than to move 100 miles away to get reeducated,(for 4 years, since I have no college degree at age 46!) only be able to see my daughter every other weekend until I finish school, and be forced to live in a much more modest home than the lifestyle I was accustomed to over the years. Unfortunately, his life will not change in the least. He will still be residing in the upscale marital home, aged 49,extremely wealthy and can enjoy his deceased parent's inheritance for the rest of his life. Anyone know the answer? Thanks for all your help!
