I understand that there is a new law called the Apprende Law that addresses convictions for "conspiracy" where the sentence has been based on quantity of drugs seized, individuals charged and the relationship of the individuals sentenced, and the conflict this presents, particularly when individuals named and sentenced were not in possession nor proven to be "distributors".
Are there recent court decisions that address this, if so where, what, when. Are there any appeals based on this new law, and any sentences revisited and revised because of it?
