Hello, I have a question regarding HUD rural development certifications. I filled out my recertification for my apartment last month but nothing has come back yet regarding what my rent will be, but I am worried because I read a clause in a paper the landlord gave me regarding certifications and it states that I am required to report my 'income change' if I make something like $250 over what my income was reported as on my last certification, otherwise it states that they can order me to pay back rent, they can raise my rent, and evict me. I am an on call 'private contractor' and I take random jobs and my cash flow is generally pretty random, and my checks don't include pay stubs so I find it is generally pretty hard to keep track of how much I make, as alot of the time I just goto the bank after getting a check in the mail and cash it right there, along with the rent from my roommate.
My employer reported to my landlord that I made about $2000 more dollars than I did last year. Would it be safe to assume the landlord will try taking corrective actions such as making me pay retroactive rent, raising my rent or possibly evicting me? I explained my situation to the landlord. My existing certification has not expired yet and I found this clause in a HUD rural development form regarding recertification.
"In processing corrective actions where existing certifications
have not expired, overage may not be charged for failure to report
changes in a timely manner and the note rate rent will not be charged.
Processing corrective actions will use the corrected accurate
information to establish the proper rent levels, subsidies, and any
overage charges using the same principles as would apply had the change
been promptly processed."
Would it be possible that the landlord is holding my certification forms until my certification expires in order to take these'corrective actions' against me?
