My husband and I moved into a new apt 5 months ago.
Almost 1 month ago we had an electrical problem in our apt.
on March 7th at around 1-2 a.m. I smelled smoke coming from the ac vent and called 911. We sat outside until 4 a.m. in the cold with our 1 yr old and 2 yr old sons before the fire dept told us that they were waiting for the fire marshall to come and make sure everything was ok before we went back inside. and that since we had the 2 children it would be best if we found a place to stay for (what was left) of the night so we went to my mothers house.
The next morning received a call from the apt. office telling us they were sorry about the "inconvience" and that we had the choice of waiting until the apt. was repaired or moving into a differant apt.- I told her I would call after talking to my husband.
My husband and I went to the apt. office (after doing some investigation I was told since I wanted to stay in the apt. that the office would have to cover the cost of housing for us until the apt. was fixed) I told the management I would rather keep the apt and stay in a hotel until the electric was fixed. I was told that was no longer an option. We were going to be moved by their moving company to a new apt.
At this time I told her I would be going to the apt to pick up some clothes (anyone w/ 1 and 2 yr old boys knows how clothes are)and other misc items until we were moved. I was told that was not possible because there were 15+ people in the apt (electricians, drywallers, investigators) and that we would have to come back after 5. At 5 I called and was told come at 6pm.
Finally we were able to go into our apt and (not believing what I was seeing) the entire kitchen ceiling, bathroom ceiling and part of the master bedroom ceiling were tore out! Ok that would be understandable if there were any immediate fire hazards. I held my tongue - even though my 1 yr olds 1st birthday cake had somehow ended up in the sink with soap and ceiling on it.. and everything in our house new or used was now covered in ceiling dust and pieces..and 5 packs of cigarettes were missing out of a new carton.
No big deal
Well the apts moving company was there the next morning and stupid us listened to them when they said they had everything under control and we didn't need to hang around, so we went to my mothers again until things were moved..
About 3 hours later we came to see how the moving company was doing and "wow" they were finished---this is a 3 bedroom 2 bathroom apt that was being unexpectedly moved so no packing was done prior-- We went into the old apt and the moving company had moved only the furniture and I would say a very few boxes. They left everything in the kitchen, alot of the kids toys, alot of clothes and other misc things that should have been no problem to move.
We arrived at the new apt to find that another pack of cigarettes were missing and my sons birthday present (a blowup ball pit) had the couch cushions, table chairs and other things in it and had a tear in the side of it. (They used it for moving!) I also could not find my wedding ring which was on the bedroom dresser (waiting to be resized). The stereo my husband moved ahead of time in pieces (so it would not be used) was all hooked up and plugged in the wall.
After being asked by the apartments if I had renters insurance and telling them no they used that as a means of getting out of the responsibility of replacing these items. I (finally using my brains) did not see how the apts. allowing these people into my apt unsupervised and not allowing me into would fall into the hands of renters insurance.. so I called and explained everything and was told that the apartments insurance would have to cover it.
After alot of stress I gave up on this.
We were told and have papers stating that the apartment would take all transfer fees (from phone, cable, etc) off of the rent for april. (I was told by the manager to wait until the 2nd of the month to pay rent to see if all of the bills would come so they could take it all off of 1 mth instead of 2.)
Well they came but up until the 1st (which is when rent is due) they made any accuse (the comps. were down, they didnt know how to prorate the rent etc.) to not accept the rent. So I did the calculation of all of the fees, gave them copies of the bills and a letter stating the amounts etc. and paid the amount that it should be.
I called the next day to doublecheck that everything was ok and was told the comps. werent working and I would get a call. Instead today I get a letter on my door stating that I owe $195.85 and a $5 late fee!!
My rent is only $749... the bills came to $160.85. I paid $588.15.
Where did I do the calculation wrong??? If Im seeing correctly they now want me to pay $40 more than my orginal rent?!?!? Or in 3 days Im evicted. Is there any legal action I can take against this??? I'm being told by everyone I know that I can also get them for mental anguish? This is VERY stressful and at this point I'd be happy to just get away from these people!!
I ALSO HAVE PAPERWORK FROM THE FIREDEPT THAT THE AREA THE SMOKE WAS COMING FROM WAS WITHIN A 2 IN AREA AND THE SMOKE STOPPED WHEN THE ELECTRIC WAS OFF AND THE ELECTRIC REMAINED OFF. THE "LIABILTY" REASON FOR NOT BEING ALLOWED IN THE APT WITH OTHER PEOPLE THERE WAS BLOWN WHEN WE WERE ALLOWED IN AFTER 6PM AND THERE WERE WIRES HANGING FROM THE CEILING, AND NAILS AND GLASS ALL OVER THE FLOOR!!
