nontax federal debt subject to IRA and 401-k

The only further detail are that the nontax federal debt is a civil monetary penalty and the IRA accounts are held in brokerage accounts and the 401-k is in Blackrock mutual funds via an employer and is 40% vested.

If there is no relationship between the misconduct and the plan the answer is generally yes. However there is some case law where the court has forced disgorgement. And, I'm not sure you can BK your way of the penalty, so, I'd see an attorney with your specific facts, including how long such a penalty can stay open.
