What is the name of your Province? Ontario(sorry all, no Canadian dui forums)

i applied for legal aid and im waiting on them to tell me if im eligible or not. I myself would plead guilty but im willing to do anything to not have my license suspended for a whole year.

So say i get a lawyer from legal aid.. he/she is there to do anything they can to help reduce the penalties right?

Also having a prior criminal record having nothing to do with DUI shouldnt affect my penalties, or will they? I mean i know its not going to help or look good but it had nothing to do with drinking and driving..

i know i did wrong and will get some sort of punishment but i really do not want that year suspension..

also i havent drank since this happened (been about a month almost?) and dont plan on anytime soon

any info would be appreciated

well my mom is telling me that the police made a few mistakes by getting me to sign stuff when i was drunk and breath testing me twice within 15 mins. I personally dont even want to bring that up but if it will help then sure.

The thing i would like to argue (or get the lawyer to) is that me not having my license for a year is REALLY crippling to me. If they really want me to suffer their going to do that. I can see getting the $600 fine and going to the alcohol course (which costs another $475) and getting raped by state farm for the next three years to be a fair punishment. Another thing is i havent drank since this and dont plan on doing so anytime in the future. Where i live there is no work and no public transportation (in the sticks)

i mean will the judge take into consideration that im not making money anymore because of this? if i get community service how the hell am i gonna get there? do they look at these types of issues or no?

this post might come off as being self centered, if it does my apologies.

Your lawyer is only as good as your case.

I think OJ would argue with you on this one judge. Sometimes it is the other way around.

Before anybody yells at you for asking about Canadian law (which I do not believe anybody here actually has any true knowledge of nor experience with), I have found that it rarely hurts to have an attorney assisting you. Not only can they make the process easier for you, they often are aware of what a particular judge often looks for in making a decision that would lessen your penalties. An attorney's knowledge of the court can be a very important factor in the severity of your punishment. Although, his competence is the most important factor.

by the way:

WRONG!!! Any prior criminal actions that can be brought into court will have a negative effect on your penalties. It shows a pattern of disregard for authority and the laws.

An attorney would be a good idea for you.
