I am starting a new line of clothing and would like to name my company after a fictional character in the novel Fountainhead by Ayn Rand Copyright 1943. Can I do this?

Not as common as Kleenex

The name is Howard Roark. He is the main character in the book and is supposed to represent the "perfect man". I guess his name is well known amongst all architects, designers, and literary groups. Although, it's definitely not as common as Kleenex.

You would need to find where Fountainhead was published. If so, then contact that publisher to ask your question. So far, I know that copyright is 75 years which 1943 hasn't reached that far yet.

I believe you can change the spelling of the name...down in the south we pronounce that name as (Row-ark) and not (Rourke)...or use the abbreviation of the first name...H. Roark after all H can stand for anything...
