Arrears, Failure to gain employment

What is the name of your state (only U.S. law)? NY

My ex is gaining on $1000 in arrears and has been fired from his job since the beginning of the year. He would be more, however, part of his refund was allocated to the arrears in May.

Since then, he has stated he has gotten employment but with no starting date. He is only looking for work in one area (not in the area in which he lives, but an area where he is not allowed to take our child) and has made it clear that is where he wants to go. His line of work has been advertised in multiple other areas of the state many times since.

Anyone have any insight on what would be recommended and how much longer I should wait?

Did child support remain in effect since he lost his job? If so, the arrears will continue to grow. Some amount of patience is justified - even after he starts work, it will probably be a little while before the system starts collecting. If you're not using the state child support collection department, I would suggest that you do so - and let them know where he'll be working. As soon as he starts working, collection will start.

Yes, we are going through the collections. I insisted on that when we went to support court. The arrears still gains every week. He never took it back when he lost his job.

Then just chill out for a while. You don't even know if he has started the new job yet.

Of course, nothing is stopping you from asking him when his job starts. Even divorced people are allowed to talk to each other. In fact, believe it or not, it's encouraged when kids are involved.

Okay! Thanks...will do. He told others he got the offer a month and a half ago and told me he just got it two weeks ago. His total reflects about 5 months-worth of arrears. I am merely worried since I am facing a potential layoff. I will know about that in a couple weeks, at least.

I could be wrong, but it looks like, by looking at the account, they already started seizure. The amount was too strange, for one...under the minimum and it was $XX.06. Now, hopefully, I won't receive that layoff notice. They were sent out Friday...
