Michigan - Relatively undereducated single Mother (accused) of a four and six year old opens front door to find a state trooper standing there. He informs her that she is accused of stealing and cashing a $229.00 money order from an individual (friend). Friend's father is a township police officer. The trooper tells her that it was reported that the friend saw accused's 6 year old with a piece of paper in his hand when they left friends house the day the MO came up missing. MO was cashed at a local liquor store but had no payee or endorsement on it. Trooper told accused that if she did not repay the money to friend within three days he would be back to arrest accused. The trooper was nothing but intimidating and adamant that accused was guilty not taking any information from the accused i.e. her side of the story. Accused's father paid money to stop accused from being arrested but wants this investigated. State trooper has failed to return several calls from accused to get copy of complaint and/or report surrounding this incident.
Did the trooper have sufficient grounds to press charges? If not, what legal steps can accused take to have money returned to father? Was this handled appropriately by State trooper or maybe a case of two cop friends helping eachother out, trying to settle things with a little intimidation? Accused qualifies for legal aide but I am trying to see if its even worth the frustration. As far as I can see the trooper had no grounds to press charges and this appeared to be nothing more than a threat to play on accused's emotions. Hard enough to beleive that the state police would even get this involved with such a small amount of money involved and truly no proof. Any ideas?
