I am an artist; right now I'm specializing in portraits & paintings (& web animations) of pure-bred dogs. Recently someone emailed me & said one of my paintings looked too much like their dog & said that they had not given "permission" for me to paint it.

Do I need permission to look at photos and paint animals? The dog is question was similar, but my painting the dog was more heavily marked with black and her dog had more white hair on it.

But what if I did paint someone else's dog and said so by its name? Is that legal? If it is, is it legal only for my personal use, by not for re-sale on my art webpage that DOES offer some of my work for sale?

What can I paint & sell, and paint & not sell? Years ago I painted portraits of Star Trek characters and sold prints at Star Trek conventions and Paramount never batted an eye.

Help!

I am in Texas.

Thanks.
