He use to date my daughter, who has her mobile home on my property and pays me $300 a month for lot and utilities. She asked me last month to evict him, and promised she would not invite him back into her home. (He interferes with her dating life and everything.) I paid $45 for a Writ of Execution yesterday and the Deputies will visit here in 4 days to post a 5 day warning for him to get his stuff and himself off of Lot D that he was 'renting'. But he has threatened me physically and verbally and last night in a text. My daughter doesn't want him around, is afraid to say NO (he hit her and the police did nothing). Do I have also have to file a protection order? Since he physcially threatened me last Friday, do I still have time to file against him? My daughter's home is too close to mine, to allow him to be in it I believe, once I get the order. If I have an eviction order for part of my land - isn't it for all of it? Can he really set up a tent, hidden in the woods and stay there for more than 3 days (time-period to remove him for trespassing) and then what I do? Can I charge him criminally for Squatting? When I won in court, I thought I was done with this mess!

What is the name of your state?

You can continue with the eviction proceeding following your state's laws on eviction and, if at any time you fear for your safety or the safety of your daughter/other family members, you should call the police and you can seek a restraining order to keep him off your property.

If the court issues the order, you can call the police if he violates any terms of the order. The police will escort him off your property and he can spend some time in jail.

If you don't want the hassle of sheriffs and restraining orders, try offering him cash. Just make sure he and his belongings are off the property when you pay him and get his signature on a release.

I'm in Missouri. I am afraid of my safety, all the time. Is fear enough to get a restraining order? Or do I have to describe the last time he either physically threatening me or his text message threat? How long after the threat, can I have before getting the restraining order?

Thank you for providing your state name.

If you are already in fear for your safety, you can seek a restraining order now. You should not hesitate to report his threats to the police.

I did offer him cash equivalent to the cost I paid for rent/possession. He said "I don't want your money". So I filed against him. A few minutes ago he texted me for some work for cash. I am broke, but don't trust him with my mower, etc. Don't want him to suck me into his web either. Suggestions? I repeatedly ask him to move or pay me or work off rent in past few months especially. He always refused because he thinks he can get my daughter to ask him to stay. As much as she hates and fears him, she did.

You need to get a restraining order and then follow through with the police when he violates it. You evicted him, you need to STOP suggesting that he can do anything to pay you back. You have to enforce the eviction order.

For the restraining order, will that keep him 500 ft from my house or from my property? If only from my house, he will still squat on my land and terriorize us all. The cops have been called several times over the years, but they don't do much. Just want money. He sweet talks them.

Restraining/protective orders can be written to meet the needs of the party seeking the order.
