Hi All Experts,

Here is my story:
I have had a 2 year lease with the Tenant until September 30th, 2014.
In June 15th, 2014, I notice the Tenant that I will not give him a new lease after the lease gets expired. (That's because I need the place for my family)
We had an oral agreement that he will move out.
However, recently when I ask the tenant about when he will move he keep telling me that he's waiting a budget from his contractor job.
Without getting that money he won't move to anywhere.

My question is:
Since I can't tell whether the tenant is telling me the truth or he just trying to playing game with the time over me, do I need to issue him a official 90 days, or 60 days move-out notice base on the lease will expired in end of september?
I know there is a 30 days notice for month to month but since this is for the 2 year lease contact? Should I better send a 60 days notice?
What is the right way to notify the Tenant with lease expiration coming with 3 month in New York State?

You , as a landlord, MUST follow the LL/Tenant law of your state.

I post a thread for help be4 and now just to update what's happening with my Tenant.
Thanks for all your guys as always providing comments & suggestion. That way I could learn through the process..
Even with the worst case that I have to hire the Lawyer I would have some knowledges about this.

Even with the worst case that I have to hire the Lawyer I would have some knowledges about this.
Honestly you should have hired a knowledgable Manage to help you as you know nothing about ll/tenant law. I don't mean to be rude or nasty...but being a LL is a HUGE responcibility. Pay for a consult with an Attorney that specializes in LL/ Tenant laws for your state.
