What is the name of your state? FL
I don't know if any of you are attorneys but any advice is appreciated. The situation is this... my husband has custody of his son...the mom hasn't been two involved before so the bond isn't that great and the only tme she sees him is the summer time. The child is 7 years old and his mom lives out of state, her new husband is in the military and she's not currently employed (by choice). Throughout the 10 months my stepson lives with us we've opened several invitations throughout the year for his mom and her new family to come down and visit him..... to no avail... her new life takes priority. Its hard on my stepson to pick up every summer for two months when his life, friends etc are here and since he doesn't see his mom any other time. This year he's been with his mom already for 3weeks of the visitation time and the entire time he's been calling crying saying he wants to come home. His mom agreed and verbally told my husband and him that she wasn't going to force him to stay. Just a few days ago we called to confirm(we were going to drive up to their house 9hrs away to pick him up) and she got on the phone and told my husband that she and her new husband discussed it and made the decision that regardless of what he's saying or feeling he needs to stay up there and finish up the time with her. What, if any, would be the options available to fix the situation so that if he does not want to go visit her or stay up there the entire time he wouldn't have to? No one is trying to deny his mom time, matter of fact we've tried to point out on several occasions that she needs to make the effort to keep her promises to him and come down to visit throughout the year but to keep him up there against his wishes is hard on him...not to mention that later on he can grow to resent her. If anyone can provide some help, it would be appreciated!
