My boyfriend was charged with aggravated assault 16 months ago and it hasn't gone to trial yet. The person accusing him was suppose to file a non prosecution affadavit (because there was no weapon or assault) but hasn't and the prosecutor says the state will pick up the charge anyway. He has gone to court 10 times so far for this charge and they keep resetting it. How long can they make this go on?
What are the speedy trial laws in Texas?
thank you

He should have his attorney file a motion to dismiss for want of prosecution, and notice that he will no longer waive his speedy trial rights.
