My son was dropping a friend off at someone's house. He surmised a fight was going to break out between 2 of the 15-20 kids at the house. He noticed one young man(A) go to the trunk of a car and take out a wrench, and start to run up to another person(B) with his arm raised to hit person(B). My son yelled, "Hey, what's with a weapon?" and attempted to grab the wrench away from person(A). Person(A)turned and hit my son on the head with the wrench. Another man(C) came up behind and tackled my son to the ground. Then persons (A) and yet another man(D) also with a wrench or lead pipe, proceded to hit my son on the head and back with wrenches. My son did not associate with either persons (A), (B), (C), or (D); nor do any of these persons know my son. My son was apparently in the wrong place at the wrong time attempting to be the "good samaritan" (next time I hope he calls 911 instead!) Anyway, persons (A) and (D) were arrested and are charged with Assault2. My son is 20 years old. Persons (A) and (D) are 17 and 16, respectively and being charged as Juveniles. Both have been in trouble before. IS THERE A CIVIL CASE HERE FOR TIME & MONEY LOST FROM MY SON NOT BEING ABLE TO ATTEND HIS COLLEGE CLASSES - MISSED FINALS/ COULD NOT START ON THE NEW JOB HE HAD BEEN HIRED FOR / HIS CAR PAYMENTS AND OTHER BILLS HE CANNOT MAKE AS A RESULT OF THIS ACCIDENT? My son had a concussion, received numerous stitches to close 2 arteries and a wound to his head and had a bruised spine. We were told that the parents are NOT responsible for (A) and (D)!!! We are located in UPSTATE NEW YORK.
