My mom was a resident of an assisted living facility and passed away 1/10/2005. At that time, the facility told me that I needed to give a 60 day notice. We were out of the apartment totally 6 days after her death and ready for rental. They received jan. rent and the last months rent in escrow for Feb. now I am being billed for 10 days in March for 677. The contract has no stipulation for "upon death" because I do understand the 60 days notice otherwise. However, the contract does state that they will try to fill vacancy and if they are successful they would credit back to the family. I asked for the date they filled her room and suprisingly they gave 3/11!! I was her POA not guardian but paid all her bills. She has no estate and we were preparing to file for Medicaid. Am I liable to pay these last 10 days? she is deceased no longer here. I understand if It were a credit card I would not be liable to pay that off (howevever, I paid 4700 on her card 1 week before she passed! ):( PS I now work 2 days a week at the facility and was surprised to receive the bill. Please advise. thanks rymo

Most Assisted Living Facility (ALF) contracts end when the resident dies. Most ALFs do charge (and have the legal right to charge) through the day that the deceased resident's belongings are removed from the ALF. Look in your state statutes (under Nursing Homes & ALF) and you should be able to find the state statute governing this. Your mother's estate is responsible for the bill, unless you made yourself the guarantor by incorrectly signing the contract making you the guarantor.
