Association denying me condo, because of False criminal record

Hello, I applied to rent at an apartment complex and I was denied based on they say that I have a criminal record.

The crazy thing is that I do NOT have a criminal record, I've never been arrested or charged with any crime and I've only had three traffic tickets in my life.

I do not know what to do as I was approved by a real estate rental company two weeks ago and they also did a background check and it was clean but I did not rent that apartment because it had mold.

the association president is being extremely nasty to me and has treated me like a complete criminal the worst thing is that I was packed and ready to relocate to that area next week, and I have a tenant moving into my condo that I live in, this has stressed me out so much, as I don't have anywhere to go.

I applied to take my real estate exam and a background check was done with fingerprints in September and it was clear.

I've tried talking to the association president but she says that I did not disclose all of my criminal records again I do not have one too I don't know what to do I can't admit to having something I don't have.

I want to sue them so bad because this has made me feel terrible as they are treating me like I am a criminal when I'm not what are my options?

Ask them (nicely) for a copy of the report they received so that you can follow up with the folks who provided the report. Perhaps you can bring some Christmas cookies along with you when you ask...

They are refusing to give me the report, even the landlord asked if he can have it and they said NO, that they cannot give it to us

It sounds like they are in violation of the Fair Credit Reporting Act (FCRA) in a number of ways. I would suggest you contact a lawyer.

Why dont you just use the links above and arrange for a consultation and if needed have the Attorney you consult with write a letter to them for you .

Yes, I will definitely find an attorney however now I've got to wait until Wednesday, because of the holidays, it's just so sad how these associations can pretty much do whatever they want.

Just wanted to let you guys know that the owner of the property that I was going to rent from before I was denied by the association did his own background check today and just called me to tell me that it was clear the only thing that came up was a traffic ticket, he will send the copy of the background check it to the association president, but I doubt she will agree to let me move in as it's obvious that she's made up her mind.

I recommend you put your immediate efforts into finding a different place to live. Even if the president reversed her stand and approved you to live there, you already have an idea of the sort of person she is and could expect even more conflicts. My observation is that the thankless task of being on a condo or homeowner's association board tends to attract those who like to be dictators and make everyone march to their tune. She may be just one of those types, and that would make your stay in that place miserable for as long as she held that position.

You know I cant help but wonder just what service they used during the process to screen you , I have found one site that when my name is searched on that there is a possible criminal history and I know its not me Because another guy with the SAME first middle init and last name in a different state does have a criminal record and there is a big difference in our ages . SO yes I agree , find a different place to live and if you can let us know the outcome on this .

There can be a big difference between background check companies.

Some will do name searches only and will add a disclaimer to the report saying that information provided may not accurately reflect the criminal history of the one whose information is being sought. Other background check companies mine arrest data from police databases but do not update the information to include dispositions (e.g., arrests that did not lead to charges, charges that did not lead to convictions).

If a consumer is denied credit, employment, a residence, as a result of information provided in the background check report, the consumer is entitled to the background check report and what entity produced it, so the consumer can dispute and have corrected any erroneous information appearing on the report.

I agree with Taxing Matters that the HOA has red flags flying and it probably would be in your best interest to find a different place to live. The initial rejection of your application, in other words, may have been a blessing in disguise.
