Asylum needed for Fiance

My fiance and I need to apply for Asylum. He is from El Salvador and to return to his country of origin would be dangerous for him. He once belonged to a gang and has left and they have overtaken his country also, there are death squads there now who have been murdering gang members past and present.

He has been gang free and led a decent life in Mexico for the past six and a half years. I am a U.S. citizen who simply wants to bring her fiance to my country and live a peaceful life rather than crossing the border every day to go to work.

I'll be honest. I'm not interested in anyone's so-called moral judgement of his past life. I've known CEO's who did worse things, including visiting 3rd world countries to practice their sick pedophilia, so spare me any moral opinions. He has helped gang members leave the gang, here in Mexico and feels bad about having belonged, so he's 100% more moral than most of the crooked CEOs for companines like Enron etc, and some of the racist people in my country.

But my question goes back to what is the likelihood of him obtaining Asylum? I know of one case this was granted. But I'm wondering if Asylum is only focused on other issues.

Being a former member of a gang won't get him asylum. he will have to apply for immigration just like anyone else.

Or wait until the minutemen leave and crawl under the fence.

Actually, precident has been set in this by one ex gang member in Los Angeles. Alex Sanchez of Homies Unidos actually succeeded in doing this. But I'm not sure how many cases they will review like this. I believe the same was done for Jesus Chavez, the boxer, who was also a gang member in Chicago and deported twice to Mexico, but I may be wrong on this one.

My problem doesn't so much lie in if it can be done, because I know it can, but how frequently they consider this or if these are unique cases. He was in the same gang as Alex Sanchez and knows him, but we are wondering if this case was only awarded due to publicity. Anyone know of any other cases and/or the frequency of these decisions?

You already stated he was caught in this country illegally plus hes a known gang member. 10 POSTS wont make him wanted or able to come here legally.
 
Minute men

Since they've already run home and given up on that project, I doubt anyone is sweating them.

But if we weren't inclined to enter illegally in six years, it's unlikely we would now. As for the minute men, if they weren't such a pitiful joke, it would be sad. I have very little respect for vigilantes, American citizens or not. They are no better than the gang members in my mind. Fortunately, the President and the INS agree with me.
 
Anyone have an opinion on this based on experience with this?

I'm not posting for opinions on whether the average Joe Blow wants him in the U.S. or not. I'm asking a relevant question. If you have no information, then please allow others to address it. Again, moral judgements are irrelevant to me. I have my own judgements as well for those.

And if I'm a law abiding citizen and can forgive a person who's proven to be a decent changed man, then I really don't care what others think. There will always be those too ignorant to understand people can change, until they want others to understand them.

If he wants to come the US as your fiance, he will have to qualify and apply for a K1 visa(and you have to qualify to be a sponsor). If he gets denied the visa, he'll get to stay in Mexico where you both "live a gang free and decent life", worse case scenario could be worse, at least he doesn't have to go back home.

This is specifically to the low class trash quoted below.

I called an attorney yesterday and hired her. She is working on our case and says our chances are excellent and probable, based on previous cases. It could take up to a year, but she's confident we will qualify for Asylum. Sponsorship is a non-issue she says, because my income qualifies over the requirement. (My field is Marketing, Advertising and PR unlike the bricklayer below) And she told me they can not keep him out based on his gang activity once his record is expunged. Especially since this was in his youth. With the L.A. system so behind, she assures me they won't want to waste the money fighting a request to expunge his record. With his current history, she is sure he'll qualify.

So...this leaves the moron below running to learn Spanish so he can simply keep up with the "scum" who speaks five languages and the my fiance laughing at another ignorant, low class idiot spewing his frustrations and racism upon the world. Nothing new really...but so vulgar when one openly brags about it in public. At least my fiance knows what he's done wrong in his past. This moron is still acting stupid in the present.
